Section 3 – Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding invitation to submit an order.
By clicking the "Buy Now" button or another correspondingly designated button, the customer submits a binding offer to conclude a purchase contract.
Receipt of the order is automatically confirmed by email. This confirmation does not constitute acceptance of the customer's contractual offer.
The purchase contract is concluded only when WANFU Trading GmbH expressly confirms the order or dispatches the goods.
If, despite careful inventory management, a product is unavailable, WANFU Trading GmbH reserves the right not to accept the customer's offer. Any payments already made will be refunded without undue delay.
Section 4 – Prices
All prices are stated in Euro (€).
Unless otherwise indicated, all prices include the applicable Austrian Value Added Tax (VAT).
Shipping costs are displayed separately during the ordering process.
The prices applicable at the time the order is placed shall apply.
Obvious pricing errors remain reserved.
Section 5 – Payment Terms
Customers may only use the payment methods offered in the online shop.
The customer's payment method will be charged in accordance with the terms and conditions of the respective payment service provider.
WANFU Trading GmbH reserves the right to exclude individual payment methods in specific cases.
Section 6 – Delivery
Delivery shall be made to the delivery address specified by the customer.
Any delivery times stated are non-binding estimates unless a binding delivery date has been expressly agreed.
Should delivery delays occur, the customer will be informed without undue delay.
If delivery becomes permanently impossible, WANFU Trading GmbH shall be entitled to withdraw from the contract. Any payments already made will be refunded without undue delay.
For consumers, the risk of accidental loss or accidental deterioration of the goods passes only upon delivery of the goods to the consumer or to a person authorised by the consumer to receive them.
Section 7 – Retention of Title
The delivered goods shall remain the property of WANFU Trading GmbH until full payment has been received.
Section 8 – Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with the provisions of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz – FAGG).
Details regarding the right of withdrawal, including the conditions, deadlines, and consequences of withdrawal, are set out in the separate Withdrawal Policy available on this website.
Section 9 – Statutory Warranty
Consumers are entitled to the statutory warranty rights provided under Austrian law, in particular those set out in the Consumer Warranty Act (Verbrauchergewährleistungsgesetz – VGG) and the Austrian Civil Code (Allgemeines Bürgerliches Gesetzbuch – ABGB).
For new goods, the statutory warranty period for consumers is generally two years from the date of delivery. This applies irrespective of whether the respective product is designated as household equipment or commercial equipment.
For contracts concluded with entrepreneurs within the meaning of the Austrian Commercial Code (Unternehmensgesetzbuch), the statutory warranty period for new movable goods is limited to one year from delivery, to the extent permitted by law.
Customers are requested to report any obvious transport damage to both the carrier and WANFU Trading GmbH as soon as possible after receipt of the delivery. The statutory warranty rights of consumers remain unaffected.
Section 10 – Liability
WANFU Trading GmbH shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, WANFU Trading GmbH shall only be liable for the foreseeable damage typical of the contract.
To the extent permitted by law, any further liability is excluded.
Liability under mandatory statutory provisions, in particular the Austrian Product Liability Act, shall remain unaffected.
Section 11 – Product Information
Product descriptions, technical specifications, illustrations, and colour representations are provided for general information purposes.
Minor deviations, particularly those resulting from technical developments or differences in screen displays, shall not constitute a defect, provided that such deviations are reasonable for the customer.
Section 12 – Intellectual Property
All content on this website, including but not limited to texts, images, graphics, logos, product images, videos, and other materials, is protected by copyright, trademark law, or other intellectual property rights.
Any use beyond the limits permitted by law requires the prior written consent of WANFU Trading GmbH or the respective rights holder.
Section 13 – Data Protection
Information regarding the processing of personal data can be found in the Privacy Policy available on this website.
Section 14 – Applicable Law
These GTC shall be governed by the laws of Austria, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
In relation to consumers, this choice of law shall apply only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
Section 15 – Final Provisions
Should any provision of these General Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
The invalid or unenforceable provision shall be replaced by the applicable statutory provision.
